Orders of protection were designed to protect victims of domestic violence from further acts of violence, threats, and abuse.  Sometimes referred to as protective orders or restraining orders, orders of protection are extremely effective in preventing an abuser from continuing to harass, harm, or inflict violence on the victim. After a victim has obtained an order of protection from the court, his or her abuser will no longer be able to come within a certain distance of the victim or engage in any type of contact with the victim. Orders of protection can protect the victim and those members of the family residing with the victim, such as their children. In situations where the victim and the abuser have children together, and they have a custody arrangement in place, the Order of protection can be worded appropriately so that the parties can communicate with each other only as to matters that effect the children. 

Types of Protective Orders

There are two main types of Orders of protection a person can seek if he or she is being abused or mistreated by a family member. These include:

  • Refrain-From Orders: This type of order prohibits the abuser from engaging in certain behaviors, such as making threats, inflicting violence, harassing the victim, stalking the victim, etc. A refrain-from order also prohibits the abuser from making any type of contact with the victim, whether it is over the phone, by e-mail, via text message, in person, or through standard mail.
  • Stay-Away Orders: This type of order bans the abuser from coming within a certain distance of the victim and his or her children. This includes coming within close proximity to the victim's home, workplace, or any other place he or she frequents.
